Website Privacy Policy
Effective Date: April 10, 2026
1. INTRODUCTION
This Privacy Policy describes how ClinikaPath ("we", "us", or "our") collects, uses, and discloses personal information through the ClinikaPath marketing website (the "Site").
Scope Limitation:
This Privacy Policy applies solely to the Site. It does not apply to any data processed within the ClinikaPath software application (the "App"), which is governed by a strictly separate Zero-PHI Privacy Policy and Software-as-a-Service Agreement.
By accessing or using the Site, you acknowledge that you have read and understood this Privacy Policy and consent to the collection, use, and disclosure of your information as described herein, in accordance with applicable data protection laws, including the Canadian Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable United States privacy regulations.
2. INFORMATION WE COLLECT
a) Information You Provide Voluntarily
We collect personal information that you voluntarily provide when you submit a contact form, subscribe to newsletters, or request information about our services. This information may include your name, email address, clinic or business name, and any other details you choose to provide.
Important: You must not submit any sensitive personal information or Protected Health Information (PHI) through the Site.
b) Information Collected Automatically
We automatically collect certain technical and usage information when you access the Site, including your IP address, browser type and version, device type and operating system, pages visited, time spent on pages, and referring/exit URLs. This information is collected using cookies, pixels, and similar tracking technologies.
3. COOKIES, TRACKING TECHNOLOGIES, AND "DO NOT TRACK"
We use cookies and similar technologies to ensure proper website functionality, analyze traffic, and support marketing efforts. You may manage or disable cookies through your browser settings, though this may impact Site functionality.
Do Not Track (DNT):
Some web browsers incorporate a "Do Not Track" feature. Because there is not yet an accepted standard for how to respond to DNT signals, our Site does not currently respond to them.
4. USE OF GOOGLE ANALYTICS
We use Google Analytics, a web analytics service provided by Google LLC, to better understand how users interact with the Site. Google Analytics collects information such as your IP address and usage behavior. This information may be transmitted to and stored on servers outside Canada, including in the United States. You can opt out by installing the Google Analytics opt-out browser add-on.
5. HOW WE USE YOUR INFORMATION
We use personal information collected through the Site to:
- Respond to inquiries and provide customer support.
- Communicate with you, including sending marketing communications.
- Improve and optimize the Site and user experience.
- Monitor and analyze usage trends.
- Comply with legal and regulatory obligations.
Anti-Spam Compliance:
All marketing communications comply with the Canadian Anti-Spam Legislation (CASL) and the US CAN-SPAM Act. We will obtain your express consent where required by law, and you may opt out or withdraw consent at any time using the "unsubscribe" link in our emails.
6. DATA SHARING AND DISCLOSURE
We do not sell or rent personal information to third parties. We may disclose personal information:
- To trusted third-party service providers (e.g., hosting providers, analytics providers, email platforms) who require access to operate the Site and are contractually obligated to maintain confidentiality.
- Where required by applicable law, regulation, legal process, or governmental request.
- To protect our legal rights, property, or safety, or that of others.
- In connection with a business transaction (e.g., merger, acquisition, asset sale), subject to appropriate confidentiality safeguards.
7. CROSS-BORDER DATA TRANSFERS
Your information may be stored and processed in jurisdictions outside your province, state, or country, including the United States. These jurisdictions may have different data protection laws than those in Canada. By using the Site, you consent to such transfers, subject to safeguards consistent with applicable legal requirements.
8. DATA RETENTION
We retain personal information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. When personal information is no longer required, it will be securely deleted or anonymized.
9. SAFEGUARDS AND SECURITY
We implement reasonable administrative, technical, and physical safeguards designed to protect personal information against loss, theft, unauthorized access, disclosure, copying, use, or modification. However, no method of transmission over the Internet or electronic storage is completely secure, and we cannot guarantee absolute security.
10. YOUR PRIVACY RIGHTS (CANADA & UNITED STATES)
Subject to applicable law (including PIPEDA and applicable US State Privacy Laws such as the CCPA/CPRA), you have the right to:
- Request access to the personal information we hold about you.
- Request correction of inaccurate or incomplete information.
- Withdraw consent to the use of your information.
- Request deletion of your personal information.
- Opt-out of the processing of your data for targeted advertising.
To exercise your rights, please contact us using the information below. We will not discriminate against you for exercising any of your privacy rights. We may require verification of identity before processing your request.
